Genesis Virtual Guide app privacy policy

The purpose of this Genesis Virtual Guide App Privacy Policy (this "Policy") is to describe to users of the Genesis Virtual Guide App (the "App") what information is collected by Genesis Motor America (together with Genesis affiliates, retailers, and service providers, "Genesis," "we," "us" or "our") may collect in connection with the App and the related services, why we collect it and under what circumstances and in what ways that information may be used or shared with our affiliates and third parties. This policy is supplemented by the Website Privacy Policy and the Vehicle Owner Privacy Policy, which are incorporated here by reference for their respective scopes. In the event of any conflict between this Policy, the Genesis Website Privacy Policy and/or the Genesis Vehicle Owner Privacy Policy, this Policy shall govern with respect to the Genesis Virtual Guide App.

1. Subscriber Consent

PLEASE REVIEW THIS PRIVACY POLICY CAREFULLY. By using the App, you accept the terms of this Privacy Policy and the Virtual Guide Terms and Conditions. IF YOU DO NOT AGREE WITH ANY PART OF THIS PRIVACY POLICY OR THE TERMS AND CONDITIONS, THEN PLEASE DO NOT USE THE App.  The App and information on it is intended for use and access by U.S. residents only.  Genesis does not knowingly collect, process, access or intend to access the personal information of persons residing outside of the U.S., including in Europe and China.  If you do not reside in the U.S., you should stop accessing this App.  Instead, you should visit the Genesis-affiliated website and use apps applicable to your country or region. 

We do not knowingly collect or maintain Personally Identifiable Information from any person under the age of thirteen (13) as they are not of driving age. No parts of our Services are directed to or designed to attract anyone under the age of thirteen (13).

2. Definitions

“Personally Identifiable Information” is information that may be used to identify or contact a specific person. Personally Identifiable Information may include: (1) identifier data (name, address, city, state, zip code, email address, telephone number, and IP address); (2) demographic data (such as age range, gender, birth month); (3) vehicle information (vehicle identification number (VIN), make, model, model year, selling dealer and date of purchase or lease); and (4) credit card number and payment card information.

“Non-Personally Identifiable Information” is information that, by itself, does not identify the individual, such as the operating system you are using, the date and time stamp of your visit, referring URLs, your Internet service provider, browser type and related browser data, the pages you visit and purchase history. 

3. The Information We Collect

Genesis does not collect any of the above user Personally Identifiable Information or non-Personally Identifiable Information when you use this App. Further, while the AR Manual, Button Scanner, and AR Capture features require permission to access your mobile device camera to use, we do not collect any sensor data or other information from the camera when you use these features in the App.

4. How we Share This Information

Genesis does not share any user Personal or non-Personal information with any third party vendor or service provider when you use this App. Because Genesis does not collect any information when you use the camera-based AR Manual, Button Scanner, or AR Capture features in the App, Genesis does not share any camera sensor data with any third party vendor or service provider.

5. Effective Date and Changes to Privacy Policy

The Effective Date of this Policy is set forth at the top of this Policy. Genesis reserves the right to change this Policy at any time. Genesis will use, share, and disclose all personal and other user information in accordance with the Policy in effect at the time the information is collected. We will post any changes to this Policy here, so check back frequently so that you are always aware of what information we collect, how we use it and under what circumstances we may disclose it. Continued use of this App following changes to these terms will mean that you accept the changes.
