What is CCPA?

The CCPA stands for the California Consumer Privacy Act.  The CCPA is a California consumer privacy law that requires businesses to make certain disclosures to California consumers regarding the collection, use, and disclosures of personal information.  In addition the CCPA grants California consumers certain rights with respect to the personal information that businesses collect about them.  For more information regarding GMA’s personal information processing activities, including with respect to CCPA-related requirements, please see our Privacy Policy https://www.genesis.com/us/en/my-privacy-rights.html#website.

                                                                                                                                                      

How does it affect me?

How do I submit a CCPA request?

To submit a CCPA request, the preferred method is to go to the Genesis owner’s website and make a request

Is the website the only way to submit a request?

Can someone submit the request on my behalf?

Yes – you may authorize an agent to submit a request on your behalf.  Please note that we will require the agent to certify that they are authorized to make a request on your behalf, and, in some circumstances, we may require you to verify your identify yourself and not via your agent. 

                                                                                                                                                      

I don’t have a computer, what do I do?

You may also submit a request by using your smart phone or via a public computer in a local library. You can also have someone submit a request on your behalf using a computer.

                                                                                                                                                      

How long does the request take?

The CCPA allows us 45 days to respond to a verified request of your data, or to delete your personal information.  In some circumstances, we may extend our time to respond by an additional 45 days. If we do extend our response time by an additional 45 days, we will let you know we are doing so within the original 45-day period.

In the Personal Information Request page, select the “Check Status of a Previous Request” and enter your request number received from Genesis via email

It has been 45 days and I still have not received my report, what do I do?

The customer will receive a notification if we cannot satisfy the request in 45 days. What does the CCPA report contain?

If you make a request for a copy of the personal information we have collected about you during the prior 12 months, we will provide you with a document that includes the specific pieces of personal information that we have collected about you during that time.

 

If you make a request to know what information we have collected about you during the prior 12 months, we will provide you with a document that describes:

 

•        The categories of personal information collected;

•        The categories of sources of personal information;

•        The business and/or commercial purposes for collecting and selling their personal information;

What information can I request to be deleted?

You can request that we delete your personal information, but please note that the CCPA includes several exceptions to deletion requests. 

                                                                                                                                                      

What customer information does not get deleted and why?

The CCPA provides several exceptions to a consumer’s right to have their information deleted. These exceptions are:

 

·       To complete the transaction for which the personal information was collected, provide a good or service requested by the California resident, or reasonably anticipated within the context of a business’s ongoing business relationship with the California resident, or otherwise perform a contract between the business and the California resident.

·       To detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity.

·       To debug to identify and repair errors that impair existing intended functionality.

·       To exercise free speech, ensure the right of another California resident to exercise his or her right of free speech, or exercise another right provided for by law.

·       To comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code.

·       To engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the businesses’ deletion of the information is likely to render impossible or seriously impair the achievement of such research, if the California resident has provided informed consent.

·       To enable solely internal uses that are reasonably aligned with the expectations of the California resident based on the consumer’s relationship with the business.

·       To comply with a legal obligation.

·       To otherwise use the California resident’s personal information, internally, in a lawful manner that is compatible with the context in which the California resident provided the information.

                                                                                                                                                      

What do I do if Genesis refuses to delete the information I request?

How many times can I request the report?

You can request your data or a copy of your report twice in a 12 month period.

                                                                                                                                                      

I forgot or can’t find my confirmation number to follow up on my request. What do I do?

How do I know my request went through?

You will be notified of your request number through MyGenesis website and will also receive this information in an email.

                                                                                                                                                      

If I request my information be deleted will future collection of this data also be deleted?

 

No – when you request deletion of your personal information, subject to any applicable exceptions to deletion, we will delete the personal information we have in our then-current records. We may collect additional information from you in the future, including information that you provide directly to us and as we may otherwise collect as described in our Privacy Policy https://www.genesis.com/us/en/my-privacy-rights.html#website.

Why did I not receive all the information in my access report?

Hyundai/Genesis will not provide information you have shared that we consider to be sensitive personal information, including geolocation information and credit card information. We also will not provide information you have given our authorized dealers/retailers that has not been shared with us.
